Establishment of Protected Areas can have enormous consequences not only for biodiversity conservation, but also for the individuals that live in the area. Unfortunately, many countries establish protected areas illegally and with complete disregard to the indigenous people that inhabit the area. This WRI initiative examines the law and practice of eminent domain and seeks to identify ways to ensure that this process is democratic. The primary issues that WRI and its partners are exploring include how decisions are made regarding the design, management, and establishment of proposed protected areas; how decisions are made regarding whether establishing a protected area is in the public interest and consistent with a government's exercise of eminent domain authority; and how to ensure that actions taken by governments in the "public interest" are in accordance with due process, transparency, and just compensation.
